Privacy Policy

How Elevex LLC collects, uses, and protects the personal information of visitors and clients — including your rights under the CCPA and other state privacy laws.

1. Introduction

1.1 This Privacy Policy (this "Policy") describes how Elevex LLC, a Florida limited liability company ("Company," "we," "us," or "our"), collects, uses, discloses, and protects personal information collected through our website https://elevexmedia.com (the "Website"), our services, and other interactions with you.

1.2 This Policy is designed to comply with applicable United States federal and state privacy laws, including without limitation the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the "CCPA"), the CAN-SPAM Act, and other applicable state privacy laws.

1.3 By accessing the Website or using our services, you acknowledge that you have read and understood this Policy. If you do not agree with any part of this Policy, please do not use the Website or our services.

2. Scope

2.1 This Policy applies to personal information we collect: (i) through the Website; (ii) in connection with the provision of our services; (iii) through email, phone, or other communications with you; and (iv) from third parties, business partners, and public sources.

2.2 This Policy does not apply to: (i) information collected by third-party websites or services that we do not own or control, even if linked from the Website; (ii) information collected offline in unrelated interactions; or (iii) information that has been de-identified or aggregated such that it cannot reasonably be linked to any individual.

3. Information We Collect

We may collect the following categories of personal information:

3.1 Identifiers

Name, email address, postal address, telephone number, IP address, account identifiers, and similar identifiers.

3.2 Commercial Information

Records of services purchased or considered, payment method information (processed by our payment processors — we do not store full payment card numbers), and purchasing preferences.

3.3 Internet and Network Activity

Browsing history on the Website, interactions with our emails and advertisements, referring/exit pages, browser type, operating system, device information, and information collected via cookies and similar technologies.

3.4 Geolocation Data

Approximate location derived from IP address (city or region level). We do not collect precise geolocation without your consent.

3.5 Professional or Employment Information

Job title, employer, business contact information, and industry, where you provide such information (e.g., in business inquiries).

3.6 Communications

The content of communications you send to us, including inquiries, feedback, testimonials, and support requests.

3.7 Inferences

Inferences drawn from the above categories to create a profile reflecting your preferences, characteristics, or predispositions relevant to our services.

3.8 Sensitive Personal Information

We generally do not collect sensitive personal information (as defined by applicable law). If we do, we will not use or disclose it beyond what is reasonably necessary to provide the requested service.

4. How We Collect Information

4.1 Directly from You. When you fill out forms, contact us, subscribe to our newsletter, or purchase our services.

4.2 Automatically. Through cookies, pixels, web beacons, and analytics tools when you visit our Website or interact with our emails.

4.3 From Third Parties. From business partners, referral sources, publicly available sources (e.g., LinkedIn), advertising networks, and our service providers.

5. How We Use Personal Information

We use personal information for the following business purposes:

5.1 Providing, maintaining, and improving our services;

5.2 Communicating with you about your inquiries, requests, and account;

5.3 Processing payments and managing our business relationship;

5.4 Sending marketing communications (subject to your ability to opt out at any time);

5.5 Analyzing usage patterns to improve the Website and services;

5.6 Preventing fraud, unauthorized access, and other illegal activities;

5.7 Complying with legal obligations and responding to lawful requests;

5.8 Enforcing our Terms of Service and other agreements;

5.9 Any other purpose disclosed at the time of collection or with your consent.

6. How We Share Personal Information

We may share personal information with:

6.1 Service Providers. Third parties that provide services to us (e.g., hosting, payment processing, email delivery, analytics, customer support). These parties are contractually required to protect your information and use it only for the purposes we specify.

6.2 Business Partners. With your consent or as necessary to fulfill a service you have requested.

6.3 Legal and Compliance. To comply with laws, regulations, or legal process; to respond to lawful requests from government authorities; to protect our rights, property, or safety; and to enforce our agreements.

6.4 Business Transfers. In connection with a merger, acquisition, financing, sale of assets, bankruptcy, or similar business transaction.

6.5 With Your Consent. To any other party with your explicit consent.

6.6 No Sale. We do not sell personal information in the traditional sense (for monetary consideration). Certain sharing of information for cross-context behavioral advertising may qualify as a "sale" or "sharing" under the CCPA. See Section 13 for how to opt out.

7. Data Retention

7.1 We retain personal information only as long as necessary to fulfill the purposes for which it was collected, comply with legal obligations, resolve disputes, and enforce our agreements. Retention periods vary by category:

(a) Client contract data: 7 years after termination of the client relationship (matching statute of limitations for contract claims). This includes correspondence, support tickets, and intake questionnaires exchanged in the course of an active engagement;

(b) Website analytics and client portal access records (for example, when an invoice or document was opened): typically 14-26 months;

(c) Email marketing subscribers: until unsubscribe, then plus 12 months. Our suppression list — the record of addresses that have unsubscribed, bounced, or otherwise must not be contacted — is retained indefinitely. We keep it precisely so that we do not contact you again; deleting it would put you back into our mailing list. A suppression record holds only the email address, the reason, and the date;

(d) Financial records: 7 years (IRS requirements);

(e) General inquiries received before an engagement begins: 2 years;

(f) Business contact information collected from public sources (company websites, public business directories and listings) and used for business-to-business outreach: up to 24 months from collection or from the last interaction with us, whichever is later. If you ask us to stop contacting you, we delete the record or move it to our suppression list described in (c);

(g) Security and audit logs recording actions taken inside our client portal: 7 years, matching the contract data they relate to;

(h) Client portal accounts: deactivated within 90 days after an engagement ends. The underlying records remain subject to (a) and (d) above.

8. Data Security

8.1 We implement reasonable administrative, technical, and physical safeguards to protect personal information against unauthorized access, disclosure, alteration, or destruction. These include encryption of data in transit (SSL/TLS), access controls, secure hosting, and employee training.

8.2 No security measure is infallible. You acknowledge that no method of transmission over the Internet or method of electronic storage is 100% secure.

8.3 In the event of a data breach affecting your personal information, we will notify you and, where required, regulatory authorities in accordance with applicable law.

9. Cookies and Tracking Technologies

9.1 What Are Cookies. Cookies are small text files stored on your device. We use cookies and similar technologies (pixels, tags, web beacons) to operate the Website, analyze usage, and personalize your experience.

9.2 Types of Cookies We Use. Strictly necessary (required for the Website to load, to protect it from attack, and to remember your cookie choice); Analytics (to measure how visitors use the Website, including the session-recording feature described in 9.5); and cookies set by embedded third-party media (currently a YouTube video player on one page). We do not currently run advertising or retargeting cookies. A cookie-by-cookie list, captured from a real browser rather than assumed, is published at Cookies We Use.

9.3 Cookie Preferences. Analytics cookies are not set until you accept them in the cookie banner shown on your first visit. You can change that choice at any time through the "Cookie Preferences" link in the footer of every page, or through your browser settings. Note that disabling cookies may affect functionality.

9.4 Do Not Track and Global Privacy Control. We currently do not respond to "Do Not Track" browser signals, as no consistent industry standard exists. We do honor Global Privacy Control (GPC): if your browser transmits the GPC signal, analytics and session recording are treated as declined and do not run, whether or not you interact with the cookie banner.

9.5 Session Recording. Our analytics includes a session-recording feature (Yandex Metrica Webvisor). Once analytics has been accepted, it records how a visitor moves through a page — mouse movement, scrolling and clicks — so that we can see where pages confuse people. It does not record what you type: recording of form field contents is switched off at the counter level, so information entered into our forms is not captured in these recordings. Session recording does not run before consent, and does not run at all if you decline or transmit a GPC signal.

10. Email Marketing and CAN-SPAM Compliance

10.1 Basis for Sending. We send email marketing to individuals who have (i) opted in via a signup form; (ii) inquired about our services; or (iii) are existing clients who have not opted out.

10.2 Every Marketing Email Includes: Our identity as the sender; an accurate subject line; a clear identification of the message as commercial; our physical postal address; and a working unsubscribe link.

10.3 How to Unsubscribe. Click the "Unsubscribe" link at the bottom of any marketing email, or email us at privacy@elevexmedia.com with the subject "Unsubscribe." We process unsubscribe requests within 10 business days.

10.4 Transactional Emails. Even if you unsubscribe from marketing, we may still send transactional emails related to services you have engaged (e.g., invoices, project updates).

11. Third-Party Services

11.1 The Website may contain links to third-party websites or use third-party services (analytics, payment, chat, etc.). We are not responsible for the privacy practices of these third parties. Review their privacy policies.

11.2 Third-Party Services Running on This Website:

(a) Yandex Metrica — metrica.yandex.com — website analytics, including the session recording described in 9.5. Operated by Yandex; the data it collects is processed on Yandex infrastructure under a data processing agreement. It runs only after you accept analytics cookies.

(b) Google Analytics 4 — google.com/analytics — website analytics. Operated by Google. It runs only after you accept analytics cookies, and is configured with Google Consent Mode, so before consent it is held in a denied state and sets no cookies. Advertising features (Google Signals, ads personalization, user-provided data collection) are switched off, email addresses and a defined list of URL parameters are redacted before data is sent to Google, precise location and device data is disabled for the United Kingdom, Switzerland and the European Economic Area, and data tied to identifiers is retained for two months rather than the default fourteen. Google Analytics does not include session recording.

(c) Tilda — tilda.cc — the platform this Website is built and hosted on, which also provides built-in visitor statistics.

(d) DDoS-Guard — the protection layer in front of the Website.

(e) YouTube (Google) — an embedded video player on one page, which sets its own cookies as described in Cookies We Use.

11.3 Not Installed on This Website. Meta Pixel, LinkedIn Insight, Google Ads remarketing tags and third-party email marketing platforms are not currently running on this Website. If that changes, this section and Cookies We Use will be updated to match.

11.4 Services Used in Our Business Operations. Separately from the Website, we use business email and document services and cloud hosting in the course of serving clients. These process information you provide to us directly, rather than information collected from your browsing of this Website. We do not currently accept card payments online; invoices are issued and settled directly. If that changes, this section will be updated before any payment processor is introduced.

12. Children's Privacy

12.1 The Website and our services are not directed to children under 13. We do not knowingly collect personal information from children under 13. If we learn we have collected personal information from a child under 13, we will delete it promptly. If you believe a child has provided us with personal information, please contact us at privacy@elevexmedia.com.

12.2 For users aged 13-16 in states where opt-in consent is required for sale/sharing (e.g., California), we do not sell or share their personal information without affirmative consent.

13. California Residents — CCPA/CPRA Rights

13.1 Scope. This Section applies to California residents whose personal information we process. Terms used in this Section have the meanings set forth in the CCPA.

13.2 Categories of Personal Information Collected

In the preceding 12 months, we may have collected the categories of personal information described in Section 3 of this Policy: Identifiers, Commercial Information, Internet Activity, Geolocation, Professional/Employment Information, Communications, and Inferences.

13.3 Sources

Sources are described in Section 4: directly from you, automatically via technology, and from third parties.

13.4 Business Purposes

Business purposes are described in Section 5.

13.5 Categories of Third Parties

Service providers (hosting, payments, email, analytics), business partners, legal authorities as required, and successors in business transactions.

13.6 Sale/Sharing of Personal Information

We do not sell personal information for money. However, some sharing with third-party advertising and analytics partners for cross-context behavioral advertising may qualify as "selling" or "sharing" under the CCPA. You may opt out through our "Do Not Sell or Share My Personal Information" link in the website footer.

13.7 Your Rights as a California Resident

(a) Right to Know. You may request that we disclose the categories and specific pieces of personal information we have collected, the sources, the purposes, and the categories of third parties with whom we shared it.

(b) Right to Delete. You may request that we delete personal information we have collected, subject to certain exceptions.

(c) Right to Correct. You may request that we correct inaccurate personal information.

(d) Right to Opt-Out of Sale/Sharing. You may opt out at any time via the "Do Not Sell or Share My Personal Information" link.

(e) Right to Limit Use of Sensitive Personal Information. To the extent applicable.

(f) Right to Non-Discrimination. We will not discriminate against you for exercising these rights.

13.8 How to Submit a Request

California residents may submit requests via:

(i) The Privacy Rights Request form on this Website, which covers every right listed above;

(ii) Email to privacy@elevexmedia.com with subject line "California Privacy Rights Request"; or

(iii) Written request to 7901 4th St N STE 300, St. Petersburg, FL 33702, USA.

To opt out of the sale or sharing of your personal information only, the Do Not Sell or Share My Personal Information form is the shorter route.

We will confirm receipt within 10 business days and respond substantively within 45 days (extendable to 90 days in complex cases). We may need to verify your identity before processing.

13.9 Authorized Agents

You may designate an authorized agent to make a request on your behalf. We may require verification of the agent's authority and your identity.

14. Other State Privacy Rights

14.1 Residents of certain other U.S. states (including Virginia, Colorado, Connecticut, Utah, Texas, and others as their laws take effect) may have rights similar to those of California residents, including the right to access, correct, delete, and opt out of certain processing of their personal information.

14.2 To exercise these rights, contact us at privacy@elevexmedia.com with your request and state of residence. We will respond in accordance with applicable law.

15. International Users

15.1 The Website is operated from the United States. If you access the Website from outside the U.S., your information will be transferred to and processed in the U.S., which may have different data protection laws than your country.

15.2 We do not knowingly target users in the European Economic Area, United Kingdom, or Switzerland. If you are a resident of these regions and provide us with personal information, you do so at your own initiative. We will apply the standards of this Policy and applicable U.S. law.

16. Changes to This Policy

16.1 We may update this Policy from time to time. Material changes will be communicated by updating the "Last Updated" date and, where required, providing notice through the Website or email.

16.2 Continued use of the Website after changes constitutes acceptance of the updated Policy.
